Request

The request is for a variance from Edina City Code Section 36-642 to allow for a retail accessory use exceeding ten percent of the gross floor area within an existing building with less than 40,000 square feet of office space and that is accessible from the exterior of the building at 4545 77th Street West.


Overview

The applicant, Edition III DBA Droolin’ Moose, is a gourmet chocolate company and has acquired the property at 4545 77th Street West. There is an existing one-story, 20,151 square foot building on the property that the applicant intends to use primarily for office/warehouse purposes. The applicant also proposes to have a small retail store on-site of 1,006 square feet that would be accessible from the exterior of the building.

In the Planned Industrial District, City Code Section 36-642, (5) lists the following as an accessory use:

"Within buildings having office space comprising not less than 40,000 square feet of gross floor area, ten percent of the gross floor area may be occupied by retail uses allowed in the PCD-1 and PCD-2 districts, if the accessory uses are accessible only from the interior of the principal building and have no signs or displays relative to it visible from the outside of the principal building."

The proposed retail use is a permitted use in the PCD-1 & PCD-2 districts. The variance is required due to the following:

  • The building is only 20,151 square feet, 19,849 less than the 40,000 square foot requirement.
  • The proposed retail space is 5 percent of the overall building but is approximately 29 percent of the space when accounting for only the office and retail space, exceeding the 10 percent threshold.
  • The retail space is proposed to have direct access from the exterior of the building.
