This was approved 7-0 the Planning Commission on June 14, 2023.


The subject property is located on the west side of Scott Terrace consisting of a one-story rambler with a tuck-under two car garage. The homeowners are requesting 4.12-foot front yard setback variance, a .7-foot side yard setback variance for new building walls and a 1.2- foot side yard setback variance for an overhang for a new 2 story home constructed above an existing nonconforming foundation at 4236 Scott Terrace. The existing home is nonconforming regarding both south side and east front yard setback. The owner’s intend to teardown the existing home to the nonconforming foundation and extend above the basement in the same nonconforming footprint as the first floor and add a 2nd floor above to provide addition living space. The project complies with all other zoning ordinance requirements. Similar variances were granted for a flat roofed design in 2021 to extend a 2nd floor above the existing nonconforming 1st floor. It was determined that structurally the walls would need to be removed to the basement floor cap and that a flat roof was not a practical solution. The pitched roof requires an overhang that extends into the required side setback. The request is a revision to the 2021 Planning Commission variance approval for a 2-story home above the existing nonconforming basement.
