Heather Maanum on behalf of homeowners Mike and Courtney Bush, is requesting a Conditional Use permit for a stem wall with fill pad for a new home to be compliant with FEMA and with zoning variances that include a 4.09 ft setback variance from the 10 ft requirement for a 5.91 ft side yard setback on the west side of the property and for a 22.7% variance from the 50% maximum for exterior basement walls to be 72.7% above grade and therefore counted as a 3rd story. The maximum building height allowed is 2 and ½ stories with the basement counting as a story if more than 50% of the exterior basement wall is above grade.
The property is located Northeast side of Philbrook Lane at 4208 and backs up to Pamela Park.

My name is Tom Burke, a resident of Edina of for nearly 10 years. I live on the creek off Woodcrest Drive. Before that, I lived in the Pamela Park neighborhood.
There are many restrictions placed on properties from various jurisdictions when building or remodeling near the creek. These requirements are designed to ensure an adequate floodway is preserved and through hydraulic modeling, verify the proposed lot modifications will not increase the flood potential on other lots.
While complying with these and other requirements, the homeowners are requesting a series of minor variances to build a home that is representative of many new builds in Edina.
This conditional use permit should be approved. A rejection of this conditional use permit would cause undue hardship on the owners and set a bad precedent for other reasonable developments near the creek.

I’m Jamie, I live in the south Cornelia neighborhood, across the street from Mike and Courtney. They have put countless hours and effort into this very thoughtful rebuild that will meet their family’s needs and fit nicely into the neighborhood. They are, without exaggeration, the best neighbors. Kind, helpful, considerate, friendly, and they maintain great care of their property. It is my opinion that this variance should be permitted.

Hi, my name is Anne Marie Rogers address is 5641 Woodcrest Drive I kind of want to weigh in about the Conditional Use Permit for variances with variances for a new home at 4208 Philbook Lane. So, we’re guessing this house butts up to our backyard. We’re guessing this is to tear the whole house down and start over and we just have a few thoughts on that. My husband already left a message about variances and neighborhood stuff, but we’re just a little concerned about the size of it. And we also are concerned about the upkeep. We, the previous owner who’s the father of the people that are look to do it now was a great neighbor, but this house has been owned by this family now for 3 years and there hasn’t been much upkeep. So that concerns us there. Tree is falling down and hanging over the fence the pool’s been is disrepair for 3 years, which is really kind of a mosquito breeding ground. Se we just start concerned about the project a bit and always concerned about the size of it. We tried a few times to get variances for our property as we, 1st went to all the neighbors that asked for their approval and then went to the City Council and we were denied every time. Well, this is Brett Rogers at 5641 Woodcrest Drive, Edina. I am leaving a message about a hearing coming up about a Conditional Use Permit with variances for new home at 4208 Philbrook Edina, MN 55424. Our yard is katy corner to the lot in question, and my input is that the description of the various requested variances is really difficult to figure out what it means, and so I have a beef with how that is presented. It doesn’t in plain language tell how the building is going to be, and how extensive the building is going to be; however, we do not have, we don’t approve of a giant building in our neighborhood and that we would look out at in our backyard and I would thank that the codes are there for a reason. And that we wouldn’t have to speak up every time somebody wants a variance. I think that in the old days people would go to their neighbors and say, hey, I’m thinking about building this and its’s passed code. Would you allow it now? They try and sneak it by with a difficult to understand notice and hope that nobody sees it and nobody complains. I think the job in the City Council is to protect us from this sort of thing and not encourage it. We’ve had the variances denied in the past. So anyway my phone number is . Thank you.

I have lived in the Pamela Park neighbor hood for 25 years. There have been many home renovations and replacements over those years, including one of my own.
The scope of the project seems well within the range of all the construction happening and to be a reasonable request.
Mike and Courtney are wonderful people. Approval of the project would allow their children to live in the home that has been in the family for generations and live near a beautiful park in which they will play!

I have 2 questions, number 1, what is going to be done about the pool and number 2, what is going to be done about the backyard? The pool has been green and a mosquito feeding ground for 2 years and the backyard has not been taken care of, at least for those 2 years. Hi, I live in the Pamela Park neighborhood near this project. I believe that property owners should be able to do reasonable projects on their property, which this certainly seems to qualify. I would hope that our city allows projects like this to proceed without interference.

Living in the area for over 38 years and being a life long Edina resident I have seen and experienced all new homes being built. What Mike and his wife are requesting seems more than reasonable based on other projects the city has approved. I would welcome the new home into our neighborhood.

I have known Mike Bush for more than 25 years. He is one of the most kind and generous people I know, and he is deeply immersed in the community, including serving as a volunteer football coach. He and his wife Courtney have a lovely family with three sweet young children. This home has been in Mike's family for multiple generations. His renovation plans are intended to be considerate and respectful of the neighborhood and residents.
