Public Hearing: Edina West Condominium Association Housing Improvement Area

The Edina City Council will hold a public hearing on Tuesday, June 6, at 7:00 p.m., or as soon thereafter as practicable, in the Council Chambers located at Edina City Hall, 4801 West 50th Street, for the purpose of conducting a public hearing regarding (i) the adoption of an ordinance to establish the Edina West Condominium Association Housing Improvement Area (the “HIA”); and (ii) the adoption of a resolution imposing fees on housing units within the HIA, all under Minnesota Statutes, Sections 428A.11 to 428A.21, as amended (the “HIA Act”).


The boundaries of the proposed HIA are shown in the map attached hereto as Exhibit A. The improvements would be financed by fees imposed on the owners of units (“Fees”) in the HIA. Details regarding the hearing, the improvements, and the Fees are as follows:


1. Persons to be heard: All persons owning housing units in the proposed HIA that would be subject to the Fees, and all other interested persons, will be given an opportunity to be heard at the hearing.


2. Proposed improvements: The proposed improvements include general renovation of the buildings and the site of the Association, including but not limited to improvements to the building exteriors; improvements to garages and tunnel; site and driveway improvements and water mitigation; improvements to common areas and the swimming pool, and mechanical system, plumbing, and electrical improvements and upgrades.


3. Estimated cost of improvements to be paid in whole or in part by the Fees: The total estimated project cost is $5,000,000 which includes construction costs, bond issuance costs, interest on the bonds, professional services costs, and the City’s administrative costs. A portion of the project costs may be paid with equity of the Association in the amount sufficient to cover any costs not paid for with bond proceeds.


4. Amount to be charged against each housing unit: The total costs will be allocated based on the square footage of each housing unit in the HIA as follows (total “Unit Fee”):

If a unit owner fails to prepay the total Unit Fee in full, the Owner will be charged an annual fee (without interest) for a period of 20 years in equal installments. The estimated annual fee imposed on each of the housing units is as follows:

The final Fees may not be more than the amounts described in this paragraph.

  1. Owner’s right to prepay the Unit Fee: Owners may prepay the Unit Fee without interest, in full (but not in part) at any time after the effective date of resolution establishing the Unit Fees. The unpaid balance will be imposed as an Annual Fee as described in paragraph 4 above.
  2. Number of years the Annual Fee will be in effect: If owners do not prepay the Unit Fee in full, the Annual Fee will be imposed and collected at the same time and in the same manner as property taxes. The Annual Fee will be payable in equal installments over a period not to exceed 20 years beginning in 2024.
  3. Compliance with Petition Requirement: Owners of more than 50 percent of the housing units that would be subject to the Fees in the proposed HIA have filed a petition with the City requesting a public hearing on the proposed Fees, the creation of the HIA and the adoption of an ordinance. This meets the petition requirements for a public hearing under Minnesota Statutes, Section 428A.12.
