The property owner at 4001 Monterey Avenue wishes to use the space above an existing detached garage as an accessory dwelling unit (ADU). The structure complies with the setbacks required for a garage but does not meet the required setbacks for an ADU. The space is currently used as additional living space for the primary residence. No changes are proposed to the footprint of the structure or the roof. To be used as an independent dwelling unit, minor modifications would be required to comply with building code, including replacement of the existing window on the west side to an egress window and adding sheetrock on the interior of the garage. Since the garage is just over 21 feet tall, a 12-foot rear yard setback is required and a 5-foot interior (south side) side yard setback is required. The garage is located 4.1 feet from the rear lot line and 4.3 feet from the interior side lot line. Therefore, a setback variance of 7.9 feet is requested from the rear lot line and a setback variance of 0.7 feet is requested from the interior side lot line.
