Public Hearing: 6.6-foot setback variance from required 50-foot pond setback at 4521 Garrison Lane

This variance was approved 6-0 at the Planning Commission on January 26, 2022.


The request is for a 6.6-foot setback variance for property located at 4521 Garrison Lane, from the 50 foot setback required from a pond to replace a deck with a 3 season porch in the same location. The homeowners would like to preserve most of the existing deck structure and upgrade it with a new roof and screens and were not aware that the deck was non-compliant. The OHWM of the pond creates an irregular shape which defines a unique buildable area for each individual lot on the pond. Due to the geometry of the OHWM many lots on the pond have sufficient buildable areas however, the subject deck to be converted to a porch is bisected through a portion of the proposed porch with the required OHWM setback.
